EXPERIENCE:
Brian Saucier concentrates his practice in the areas of First Amendment and defamation defense, newsgathering, privacy, trademarks, copyrights, and commercial litigation. As a litigator, Brian represents clients in state and federal courts at both the trial and appellate levels in a wide range of matters, including first amendment issues, trademark and copyright infringement, unfair competition breach of contract, business torts, and fraud.
Brian also advises clients in intellectual property transactions, including assignments, licensing, and the registration and maintenance of trademarks and copyrights. His clients include authors, artists, photographers, software developers, content distributors, and fashion designers. He also counsels clients on e-commerce issues, such as domain name maintenance and protection, website terms of service provisions, regulatory compliance, and other Internet-related matters.
In his media and First Amendment practice, Brian represents media clients in litigation and pre-publication review of content, and has advocated on behalf of physicians, lawyers, politicians, professionals, businesses, and labor organizations in libel, slander and privacy cases addressing important First Amendment issues such as opinion, innocent construction, commercial speech, general and limited purpose public figures, qualified and absolute privileges, and actual malice. Brian also advises media clients on newsgathering and privacy issues.
Brian is a co-author of Creatorlaw, a blog providing legal and business insights for creators of comics, games, video games and other media, and has given presentations at comic and pop-culture conventions across the country on legal issues faced by artists, writers, and publishers. Brian is also a contributing legal editor for the Comic Book Legal Defense Fund and a member of the Media Law Resource Center
