Mandell Menkes has for many years represented and advised employee pension and welfare benefit plan sponsors, administrators, trustees, investment managers and other fiduciaries in the establishment and operation of ERISA pension and welfare plans.  The firm has served as lead counsel for pension and welfare plan fiduciaries in litigation involving plan benefits and administration including claims for benefits under Section 502(a) and claims for breach of fiduciary duty and promissory estoppel.  During the course of this representation, the firm has confronted the many issues that typically arise in such cases including the preemption of state law claims, the exhaustion of administrative remedies, the standard of review, the impact of inconsistent plan documentation and a claimant’s allegation of conflict of interest to support discovery outside of the administrative record.

The firm’s benefits litigation group has also represented insurance carriers in individual life, health, disability and professional liability claims, including coverage determinations, claim management and bad faith litigation.  The group has also represented agent/registered representatives in disciplinary actions before the NASD.  Included among the list of Mandell Menkes clients is one of the nation’s largest group and individual life and disability insurance carriers.
